Hi All. Been away for a number of years since I left China. Lived there previously for a good number of years and work took me back home again.
Now I’m looking to come back (crazy I know…) ideally to Shanghai. However I’ve been away for about 4 years so I don’t remember some details and there are new questions I have.
A) My company has offices in Beijing, HK and Shanghai. The vast bulk are in Beijing however and they employ only 6 people in their SH office (which is a serviced office).
They have told me they have employed foreigners in their Beijing office before but that they “Shanghai legal entity is not setup to employ foreigners in Shanghai” is this remotely true/make any sense?
I said well…….give me a BJ contract and based me in SH. They said they can’t do that either.
B) The alternative is HK (where I’d rather not be). However I’m wondering if its still possible to be on a HK Employment Contract but living and working in SH.
Under what conditions could I get away with that? I’m aware its a tricky area and I had heard the Gov has cracked down on that somewhat.
If it helps I work in a “HR Regional” style position and my responsibilities are infact NOT in China. Just my company is happy to place me there because I wish to be there.
