WFOE set-up – notarizing/certifying UK Passport in China

Hi everyone,

I’m setting-up a WFOE in China and my lawyer told me I need to get my Passport notarized in the UK and certified by the Chinese Embassy/Consulate in the UK. See below

1. Has anyone here successfully notarised and certified their (UK)Passport while living in China without returning to their home country? If so how?

” As the investor, you need to have your identity notarized in the UK and certified by the Chinese embassy/consulate in the UK, which means you will have to go back to your home country to satisfy the requirement.

Therefore, if you hope to get the company registered within the next couple if months, you will need to go back to the UK to complete the notarization and certification work, which can take at least a week.”

I just updated the information in my question above as I maybe didn’t make it clear I need my Passport both notarized and certified in order to set-up a WFOE here in China.

Did you get your Passport both notarized and certified or just notarized by the UK Consulate?

Any idea how I can get both done while living in China, as my Chinese Lawyer (who has 20+ years experience and lots of multinational clients in China) is convinced I need to get my Passport notarized in the UK and certified by the Chinese Embassy/Consulate in the UK.

Are you sure you need to notarize anything? I just set up my company, with my UK passport, and didn’t need to go through this hassle.

I’m setting up the company in Shandong province so maybe this changes the goal posts a bit. As I wrote I trust the lawyer I’m working with, and I know he has worked with several foreign companies and is very experienced. Did you use an Agent to set up your company as opposed to a Lawyer?

I guess I will ask a few other Agents/consultants and some other people that have set-up WFOE’s in Shandong.

I don’t see why you need to use a lawyer; most of them just outsource the applications to agents anyway.

If you need the agent who helped me, i can give you their number.

Really helpful if you have any questions at any time along the way. I had millions and i thought i was a pain in the butt to them. but they gladly did everything.

I decided to use this lawyer as he only charges a little bit more than the other consultants I met and has excellent connections, not to mention 20 years of experience. I know he works with some big companies and if the @hit hits the fan (which it probably will do at some point…as it’s China after all!!) I would much rather have his number in my mobile phone than the other consultants/(or so-called) lawyers I met. Maybe in Shanghai, the consultants are more professional and well-connected.
